For and in consideration of being allowed to take golf lessons and/or fitness training, as a prerequisite for such lessons or training, from any instructor of Golflogic, Inc., 3470 Wilshire Blvd, STE 1115, Los Angeles, CA 90010, hereinafter called Instructor, you do hereby covenant, represent and agree as follows:
You are familiar with the hazards of the course where you will train and recognize that Instructor cannot control the factors which can make golfing and exercise hazardous. You realize that certain conditions like your health, fitness level, pre-existing injuries, wind, fog, rocks, sand traps, cliffs and other golfers can cause injury to you or result in your death. You have been examined by a physician and have no physical condition or injury which may adversely impact my ability to engage in golf or fitness activities safely.
Also, the services provided by Instructor may include the recommending of golf and/or fitness equipment. Accordingly, while Instructor will endeavor to recommend the appropriate equipment, you understand and agree that Instructor does not manufacture the equipment provided and makes no warranty as to the fitness of such equipment for the purpose of golf or fitness training.
Instructor emphasizes safety in the lessons and endeavors to keep every pupil as safe as possible. You acknowledge that participation in an activity like golf involves the risk of injury and can possibly lead to serious and permanent bodily injury, disability or death. You will ensure that, while participating in any golf activity with Instructor, you will familiarize yourself with your surroundings and avoid injury to yourself and others.
You voluntarily assume all risks of loss, damage, injury (which may result in your death) that you may sustain while participating in the golf or fitness training required during the instruction of Instructor and while practicing during such instruction or on your own.
WITH THE ABOVE UNDERSTANDING YOU HEREBY RELEASE AND HOLD HARMLESS INSTRUCTOR OR ANY OF INSTRUCTOR’S STAFF AGENTS, OWNERS, OR ANY AFFILIATE ASSOCIATION FROM ANY AND ALL LIABILITY OR RESPONSIBILITY, NEGLIGENCE, CAUSES OF ACTION, CLAIMS, DEMANDS AND DAMAGES OF EVERY KIND WHICH MAY ARISE OUT OF YOUR PARTICIPATION IN ANY ACTIVITIES INVOLVING GOLF AND/OR FITNESS INSTRUCTION FROM INSTRUCTOR.
